PROTECTION OF PRIVACY

KMF recognises the importance of protecting the privacy of prospects, customers, employees, investors, suppliers, JV partners and people who visit our website. This Data Protection Policy describes what data is collected by the KMF GROUP companies through our websites, our locations and in the course of your communications with us. It also informs you about your rights and the choices you can make about the use of your personal data and how we protect your personal data.

SCOPE AND DEFINITIONS

Although this website may contain links to other websites, this Data Protection Policy refers to this website kmf.at operated by KMF Maschinenfabriken GmbH. Unless otherwise stated, all references to “KMF”, “we” or “our” in this Data Protection Policy refer to KMF GROUP.
Some of the pages may contain links to the websites of other KMF companies or to the websites of third parties. KMF is not responsible or liable for the Data Protection Policy or practices of those websites. We recommend that you review the Data Protection Policy of every website you visit.
For the purposes of this Data Protection Policy, “personal data” means all information, such as name, email address or telephone number, that relates to or makes an identified natural person identifiable.

USE OF THE DATA WE COLLECT

You can visit our pages and learn about our products, services, companies and global activities without providing any personal data. In order to send enquiries, use certain services or receive newsletters, you must provide certain personal data. KMF does not collect any personal data unless you voluntarily provide it. You may also choose to provide us with personal data when you visit KMF locations or communicate with us by mail or email.

Inquiry/Registration Forms:
We may ask you to provide personal data so that we can respond to your questions or any other requests you make to us through the website. With our enquiry forms, we collect your name, email address, mailing address, other contact information (company, position in the company, address, telephone number) and information about your company. We may also ask you for additional information related to specific products, services, events or other activities in order to better tailor your use of the website or the offers we make to you. When we collect your data, we will inform you which information is mandatory and which is optional. Non-personal data:
We also collect non-personal data, such as the internet browser you use, your operating system and the IP address of the website from which you access our pages. We use this information to customize our pages to better match your computer settings, interests and preferences.

Video surveillance:
Purposes of video surveillance
Ensuring the safety and protection of people who work for us, visit us or work with us, as well as our property and our premises; preventing, containing and clarifying potentially criminally relevant behaviour; asserting, exercising and defending legal claims.
Legal basis of video surveillance
We process data about you based on our legitimate interests or those of a third party within the meaning of Art. 6 Para. 1 lit f GDPR to protect life and limb as well as property, to establish, exercise and defend legal claims and to provide evidence in the event of criminal offences (Section 12 Para. 2 and 3 Z 1 DSG). 
We process the following categories of personal data during video surveillance: image data, spatial and temporal connection, identity of the person concerned (if recognisable).
Storage period/deletion period

We do not store your data for longer than 72 hours, unless longer storage is necessary and proportionate (for example, criminally relevant behaviour has been recorded, which must be reported accordingly, see Section 13 Para. 3 DSG). 
We share your data to the following recipients or categories of recipients.

For this data processing, we commission regular maintenance of the processed data and the monitoring system.
We share the data to law enforcement authorities, courts, and, if necessary, to legal representatives and insurance companies, provided that criminally relevant behaviour could be traced.

STORAGE

We only process personal data for as long as this is necessary for the purposes mentioned above. However, due to legal retention obligations, it may be necessary to store personal data for a certain period of time even after these purposes have been fulfilled. Personal data that must be kept harmless and free-from-complaint with respect to liability claims are stored for as long as it is necessary for this purpose.

ANALYSIS SERVICES

Several service providers who analyse website and app activities for us offer opt-out mechanisms instead of the option of preventing the use of cookies through your browser settings.
These analytics providers provide us with the following information about your use of the website and apps:
– Website activities
– Internet usage
– Your anonymised IP address
We use this data to offer tailored website and app offers to you, to personalise communications with you and to provide tailored information, invitations and offers.

SHARING YOUR DATA

KMF does not sell or rent your personal data to outside third parties for their promotional purposes, but we may share your name, address, contact details, etc. for customer service and marketing purposes. KMF may also share the personal data you provide with other affiliated companies. Except as described in the paragraphs above, KMF will share your personal datawith third parties without your consent only if necessary or appropriate to (i) process or fulfil your order, (ii) react to or respond to your requests or inquiries, (iii) engage you in promotional activities at your request, (iv) comply with a law, court order or other legal process, or (v) implement or enforce agreements with you or protect the rights, property or safety of KMF or third parties, or as otherwise permitted or required by law. In the event of a corporate transaction such as a sale, merger or reorganisation involving KMF or its parent company, personal data may be disclosed or transferred to the acquiring company or companies. KMF may collect and share aggregate website statistical data (such as sales or traffic patterns or related information) with third parties. Such shared statistics will not include user information that identifies an individual.
KMF will occasionally use subcontractors to provide certain services for KMF, such as information processing, information storage or managing communications, marketing, PR and surveys. These subcontractors must ensure the confidentiality of the data received by KMF and may not use it for any purpose other than that permitted by KMF.

HOW KMF ENSURES YOUR DATA SECURITY

When you share data via our websites, we use encryption technologies. However, data transmission over the Internet can never be 100% secure. Therefore, while we strive to protect your personal data during transmission, we cannot guarantee the security of any information you transmit to us or that we receive. All personal data submitted to KMF in writing will be kept in a secure location. We instruct our personnel and computer service providers who have access to your personal data to follow the policies set out in this Data Protection Policy and applicable laws.

SUBMISSIONS

Suggestions, materials or other intellectual property sent or transmitted to KMF through our websites or otherwise are subject to separate terms applicable to such material as identified at the time of submission (if any). If no such terms are identified, all such data will be deemed non-confidential and public and KMF will have no obligation whatsoever with respect to such data and will be free to use and disclose it without restriction, including to development and marketing products that use it.

If you do not accept the terms of this Data Protection Policy, please do not send us any personal data.

CHANGES TO THE DATA PROTECTION POLICY

KMF reserves the right to change the Data Protection Policy at any time, so please review it frequently. If we make changes to this Data Protection Policy, we will post such changes here and/or on our websites.
